SAGINAW COUNTY ROAD COMMISSION

Permits Required

1. Subsequent to the effective date of these rules, no person, organization or governmental unit shall undertake or conduct any of the following activities on or along county roadways or within county road right-of-way unless a permit to allow such activity shall have been obtained from the County Road Commission.
   • Construct, reconstruct, relocate, or surface a driveway.
   • Operate, use or maintain a new driveway.
   • Erect or suspend a banner, decoration or similar object.
   • Close a section of the County roadway to normal traffic for the purpose of staging a parade, celebration, festival or similar activity.
2. Construction of a new driveway connecting to a county roadway or reconstruction of a driveway connecting to a county roadway shall be allowed only after an approved permit has been obtained from the Road Commission.  The construction or reconstruction of all driveways shall be described in an approved permit and plans or drawings accompanying the permit, unless the Commission authorizes a change in plans.
3. When the type or volume of traffic using an existing driveway changes (to the extent there is an adverse effect on the operation of roadway traffic) because of a change in zoning or roadside development, the owner, organization or person responsible for the operation of the driveway may be required to obtain a permit and correct the driveway or driveways to the standards contained in these rules.
4. In the event of failure to comply with the terms and conditions of any permit used in accordance with these rules or failure to obtain an appropriate permit, the Commission shall have the right to halt such activity until such time as adequate corrections have been made.  All costs incurred by the Road Commission in correcting failure to comply with the conditions and standards of permits, failure to obtain a permit or defective workmanship or materials shall be borne by the applicant (or person undertaking the activity).

Authorized Agents

Applications for driveway permits shall be accepted from property owners, the owner's authorized legal agent or from governmental agencies.
